Abstract:The virtual explosion in the number of antidumping (AD) and countervailing duty (CVD) cases since 1980 has made the "unfair" trade laws the major route by which US industries seek protection. There were 494 antidumping and 306 countervailing duty investigations by the US International Trade Commission (ITC) from 1980-1990, compared with only 172 antidumping and 10 countervailing duty cases from 1970-1979. This paper investigates the economic factors that best explain the decisions of the ITC in administering the injury provisions of the AD, CVD, and safeguard laws during the 1980s.
