Abstract:How the question of industrial risks has been taken up in law? In French law, there is no general or specific prohibition against pollution. The problem has apparently been politically considered and legally formulated only in terms of the administrative management of certain nuisances. The protection of interests fundamentally involves bringing pressure to bear directly on prejudical behaviours. In other words, risk is a contingency to be managed, not a danger to be eliminated. With regard to the forms of concrete application of legal norms, there has been a transition, in stages, from a symbolic (1810) to an axiological (1917) and finally to an instrumental (1976) form.
