Abstract:In 1988, Congress introduced provisions significantly enhancing the Department's inherent authority to clarify an order's scope, with the objective of preventing importers from circumventing antidumping or countervailing duties through product shifting or other perceived abuses. The article outlines the excessive latitude which the interpretation may give the Department to expand an order's scope, as well as proposals for the adoption of new evidentiary requirements to prevent potential abuses.
