Abstract:Market definition is required if the application of Article 85, Article 86 and the Mergers Control Regulation. Although the benefits or otherwise of market definition have been hotly debated for some time, more recently the practice of defining the relevant market has been accepted and the debate has focused upon two main issues: first the weaknesses inherent in "intuitive" approaches to market definition; and second the question as to whether supply-side substitutes should be included in the relevant market or not. This article addresses these two issues.
