Abstract:Reacting to the "Bosman Judgement" and the subsequent investigations of the European Commission, the FIFA has revised its rules regarding international transfers. The regulations on the transfer of players have been amended as to conciliate the conflicting aims of ensuring the free movement of workers and providing clubs with appropriate economic incentives to invest in the training of players. As for the hampering effect transfer fees are alleged to produce on the mobility of professionals, the authors show that the European Court of Justice has started from the wrong premises, so that its verdict in the "Bosman"-case has to be considered a misjudgment. In a second step it can be shown that - contrary to the predictions of economic models - a reduction in the training efforts of soccer clubs cannot be expected (original in German).
