Abstract:Some of the different characteristics of export-restraint arrangements are first explored. The government of an exporting country may cooperate in the use of an export-restraint arrangements for various reasons. Then the analysis turns to non-government measures largely escaping the discipline of the General Agreement on Tariffs and Trade /GATT/, after which governmental measures are examined in respect of GATT obligations. After that the most significant potential exception to obligations in the GATT, namely Article 19, the escape clause, is explored. This is followed by other GATT exceptions. It seems clear that export-restraint arrangements are not consistent with GATT rules.
