Abstract:The task of reconciling the conflicting goals of environmental protection and trade liberalization will not be accomplished quickly. The decision of the Fifth U.S. Circuit Court of Appeals in Corrosion Proof Fittings v. Environmental Protection Agency is discussed. Practical consequences of the Court's decision that the private Canadian parties lacked standing (the potential for disguised protectionism when a market is served primarily by exports), and of the rejection of international law are analysed. It is entirely possible that other courts will find the Fifth Circuit's views unpersuasive.
