Abstract: | This article examines transnational law-making from the perspective of organizing. The issue is a challenge for institutional theory. The study shows that emergent and deliberate institutional strategies need to be considered in a concert instead of seeing them as exclusive opportunities. Transnational law-making in the context of commercial and corporate law is used as an example to demonstrate the argument. The nested cycle concept is applied as a framework for understanding the logics of transnational legal field. |
