Abstract: | Four Nordic countries, that is, Denmark, Finland, Norway and Sweden operate indemnity compensation arrangements (or schemes, henceforth as: shs.) for patients injured as a result of medical treatment or of taking pharmaceutical products. The existence of these shs. avoids the necessity for medical negligence or product liability claims to be resolved through the courts. The shs. are administrative / inquisitorial and cheap to operate, both as to terms of administration costs and cost of sums paid. The shs. offer significant attractions. However, the shs. are difficult to be applied in other countries given the background economic pre-conditions. |
