Abstract:In recent years there have been profound changes occurring in the structures and processes of arbitration in Britain. One of the most significant of these changes is the introduction of "Final Offer" Arbitration (FOA). In essence FOA restricts the role of the arbitrator to a choice between the latest claim of the union and the latest offer of the employer,thus avoiding compromise. The use of arbitration in Britain is compared with other types of third party intervention. Strengths and weaknesses of FOA are critically examined and compared with conventional arbitration. It is concluded that FOA has much to commend,both in theory and practice,and is suitable for "disputes of interest".
