Abstract:Japanese product liability lawsuits are rare and more difficult to win than their United States counterparts. European Union (EU) strict liability law for injuring products is in its infancy. This article uses cigarettes as a template for tracing the legal and ethical implications of the trend toward marketing dangerous U.S. products overseas. Not atypical of this trend, the largest overseas markets for U.S. cigarettes are Japan and Europe.
