Abstract:Under the present conditions, administrative means and intervention have held an important position in the emergence of state-owned enterprises. Although the merger by administrative means aims at bringing enterprises back to life, it in fact, has brought many disadvantages, such as protection of back weirdness,causing confusion in government's economic function, and its administrative function, violating the market's low and adding burdens to the advanced enterprises, which leads to their declining economic efficiency. So according to China's national condition and its present state of industrial organization, China's public policies, in terms of their contents, should encourage merger and unity, but object to administrative monopoly and unfair competition. Legal means and economic means should be as the main ones.
