Abstract:This article compares bankruptcy laws and procedures between England and Italy btw. 1880 and 1939. The author concludes that the English law was relatively more efficient because of three factors: wide usage of friendly yet public devices, deep involvement of the state in managing procedures, and the possibility of debt discharge.
