Abstract: | The monopoly in anti-monopoly law refers to the state or behaviour of subject's violating regulations and hindering competition in economic activities. Anti-monopoly law involves not only the issues concerning ban and restriction but ones related to permit and exemption. So it is not simply a negative law. What we need to point out is that its safe-guarding the economy of scale is realized mainly through its regulations on permit and exemption. So China should use well the unique mechanism of anti-monopoly law to standardize the union and merger behaviour of enterprises in an effort to look for a best combining-point between maintaining free and fair competition and using the economy of scale. |
