Abstract:Criminal law may be the strongest way of formal censorship in society. By the label as "criminal", a special stigma is attached. The United Kingdom (UK) has a long history of criminalizing conduct lacking the seriousness expected for that label. Consumer protection is an area with criminal sanctions. This article argues that it is time to reconsider the role of criminal law in consumer protection, considering alternative regimes.
