| Abstract: | The clauses on investment and capital changes in the Law of Foreign Invest Enterprises in China are different from those in "Company Law". In the aspect of treatment, foreign enterprises has two entirely different conditions: supper national treatment and secondary national treatment. China should gradually pursue national treatment toward foreign enterprises in accordance with international practice during the course of improving market economic system. Investment should be dealt with according to the regulations in Company Law and Partnership Enterprise Law. For example, investment by foreign enterprises will be gradually dealt with in accordance with the regulations in Company Law and Partnership Law; capital changes in foreign capital should be dealt with in strict accordance with Company Law although it may increase or reduce is registered capital. |
