Abstract:The article addresses the question whether the new competition regulation in Netherlands allows for reasonable exceptions in prohibited inter-firm co-operation, in other words, does it allow for the possibility of well organized though not perfect markets. An empirical case study of the relationship between the new regulation and corporate social responsibility (CSR) is conducted. The findings of the case study reveal that actors in the Dutch competition and legal environment are ready to allow for exceptions to the regulation, believing that reasonable judgements can formulate reasonable pricing, thus enabling the existence of well organized but not perfect markets.
