Abstract:Traditionally, managers could be held criminally liable only for a small group of crimes, primarily embezzlement or theft. Beginning about 30 years ago, criminal liability for managers expanded on two fronts. First, prosecutors began to apply a wide array of criminal law to events within the context of business. Next, Congress and state legislatures began enacting laws which impose criminal penalties on individual managers for specifically defined conduct while performing business-related duties.
