Abstract:The main objective of the article is to present an overview of the normative regulation on establishment of bank branches within the European Community (European Union).On the one hand the establishment of bank branches within the European Community was liberalized by the EEC Agreement (which has been replaced by the agreement on the European Union into The Agreement on European Community).The establishing of branches, banking ones too, is based on Article 52 of the Agreement, which guarantees companies, citizens of the Community freedom of establishment of branches within the Community.In addition to liberalization, the Agreement allows for certain restrictions.Besides the stipulations by the Agreement, the allowed restrictions and in the public interest and in line with the doctrine developed by the European Communities Law court.
