Abstract: | The Energy Charter Treaty promised to provide an open and non-discriminatory regime for international energy investments in the transition economies of Central and Eastern Europe and the Commonwealth of Independent States. To-date, the results have been mixed. The access provisions for the making of investments require considerable strengthening and will be the subject of supplementary treaties, currently under negotiation. In contrast, the provisions for the treatment and protection of investments are more robust, though tempered by the Transition Arrangements. |
