Abstract:The article aims to criticize the use of following concepts: self-regulation and command and control regulation. It is argued that those concepts frequently have a political function, and that they are too simplistic representing extremes seldom found in the real world. Besides, regulatory regimes will present a combination of various regulatory approaches, and the concept of co-regulation is predicted to be more productive. Drawing up restrictive definitions of distinct types of regulations is regarded as useless, whereas the assessment of them through the application of normative principles is seen much more important. The amendments to the drafting of the Audio-Visual Media Services Directive during the Parliamentary process have achieved a more flexible approach than the initial one using the narrow definitions, and it is now better suited to the recognition of existing co-regulatory regimes.
