Abstract: | The problem of applying national law in other sovereign states is discussed, focused on the US. The various bases upon which US extraterritorial jurisdiction is asserted are examined. The breadth of US jurisdiction and its affects on exporting businesses are outlined. The situation is illustrated by a brief review of routine enforcement cases and of the Siberian gas pipeline dispute. Foreign governmental reactions to US jurisdictional claims are examined in detail. Blocking legislation, judicial decisions and diplomatic efforts are discussed. Practical techniques for counseling the client caught between US extraterritoriality and foreign government defiance are summarized. |
