Abstract: | The ordinary brand is in German law defended against misuse only if the intruder product belongs to a similar product group and therefore there is a danger of confusion. Only so-called popular brands are defended against any misuse. The EC law on brand protection which ought to be adopted by every member country relies on this latter concept. |
