| Abstract: | Today, academic circles have different comments. They think that Bill of Lading is not the document of real right but of picking or creditor's right; document of real right for authority principal and different effect under different conditions; or document of title to to the goods under the transferable conditions. The conclusion is that it'd be more appropriate and in line with the practice of international trade to take the Bill of Lading as the document of picking up and thus the procedures for transaction and payment would go on normally and properly. Otherwise, it's hard to explain some practical problems with the document of real right, and it would be of much doubt whether the issue of Bill of Lading is qualified to issue the document of real right. |
