Abstract:One of the features of the English commercial courts is their refusal to become involved in matters of commercial judgement. this has many consequences, for example the reluctance of the courts to impose minimum standards of competence on directors in considering breach of their duties of care and skill. English Judges are sophisticated technicians in law, self-professed amateurs in commercial matters. Their role is to hear expert witnesses and to weigh up their professional advice.
