Abstract: | According to the guidelines developed by the U.S. Sentencing Commission, a corporation could be sentenced to pay very heavy fines. National Association of Manufacturers announced: "The proposed guidelines are extremely harsh ...and will place many businesses on the threshold of insolvency." Other similar opinions are cited. The study of the Department of Justice is discussed. Examples of violations of law are presented. Arguments for and against corporate probation - one of Commission's most innovative ideas - are offered by different bodies. The debate about shareholder responsibility and that about the relationship between punishing the executive and the corporation is discussed. |
