Abstract:In December 1985, a fine was imposed on the Dutch multinational AKZO for predatory abuse of a dominant position. An appeal by AKZO was rejected by the Court of Justice of the Communities in July 1991. This note suggests that, according to the facts reported by the Commission itself, this is a case of active competition, not of predation. Although the concept of "predatory pricing" is not used explicitly by the Commission, it is clear from the arguments used that the Commission did consider the alleged abuse as predatory.
