Abstract: | While 2000 saw proportionately more cases dispatched by the Community Courts (the European Court of Justice (ECJ) and the Court of First Instance (CFI)) than 1999, there was no diminution in the number of cases being lodged, nor in the duration of proceedings. Thankfully, concerns voiced by the ECJ that the time taken to dispose of cases is coming close to denying an acceptable level of judicial protection in the Union and, further, potentially compromises the rule of law, were taken seriously in the deliberations leading to the conclusion of the Nice Treaty. A range of Treaty amendments have been agreed which will, if implemented, bring significant changes to operation of the Community judicature. These should contribute to ensuring the effectiveness of those institutions. |
