Abstract:In the article the author tries to point out some main peculiarities and characteristics of a collective labour dispute as regulated in sixteen countries. He discusses three main questions: the idea of collective labour dispute, pre-trial and/or preliminary procedure and judicial procedure. The comparative legal theory (rarely also legislation) divide these disputes into the disputes on interest and the disputes on right. The object of the dispute is the collective, indivisible right, the parties are collective representatives of the workers and the employers. In connection with the pre-trial procedure the following questions are discussed: the idea, legal sources, organs conducting the procedure and the object and the parties. The court procedure is an exception as in the great majority of the disputes the parties come to an arrangement and/or the dispute is settled in a peaceful way.Important for the court procedure are: the idea, the role of the courts, composition of the courts and their competences.
