Abstract:Employment at will is a doctrine that either employer or employee is free to end the employment relationship at any time. Now this concept is in a transition. The courts' recent role in the gradual erosion is highlighted. Some of the most important restrictions are considered: union contracts, contract employees, voluntary grievance procedures or third party review, equal employment opportunity legislation etc. The usual prescriptions to restore control to management are harmful on employee relations. A positive alternative, a more pro active stance is suggested toward employee rights and job security. It includes the principle of termination only for just cause and the needs of the business. Various ways of dispute resolution are described.
