Abstract:The author replies to an article by Dieter Farny who defended the German regulation system for the insurance industry. Farny claims that criticism to the status quo stems from what he calls "theoretical dogma" and a lack of understanding of the insurance business. However, there are a number of studies which prove that the German insurance industry's strict regulation and its exemption from antitrust law are not justifiable neither by economic theory nor by international practice. The policy targets of a minimum product quality and an improvement of market transparency can be achieved by measures that hardly restrict competition. A general reform is called for if regulation is to protect the consumers efficiently and not the insurance firms.
