Abstract: | A trade policy review mechanism /TPRM/ was proposed in the Negotiating Group on The Functioning of the GATT system to monitor trade policies and practices; its genesis, aims and functioning is reviewed. Key features of TPRM (ts conditioning mechanism, its corrective and perspective character) are discussed. Criteria for the review may encompass legal, economic and political aspects; legal and economic criteria are analyzed, legal consequences arising from the TPRM are discussed. It is concluded, that transparency is a pre-condition of the enforcement function; TPRM is not an exercise of enforcement, but an exercise in transparency. |
