Abstract:The North American Free Trade Agreement (NAFTA), established on 1 January, 1994, contains dispute settlement mechanisms (DSMs) for trade and investment that require analysis from the viewpoint of strategic management. The DSMs of particular strategic interest are those in Chapter 19 of NAFTA dealing with disputes over anti-dumping (AD) and countervailing-duty (CVD) cases. These procedures are based upon the AD and CVD binational panels of the Canada-US Free Trade Agreement (FTA), established on January, 1989. Under the FTA procedures 49 AD and CVD cases were heard by binational panels.
