Abstract:Section 4 of the Employment Act 1980 provides a statutory right not to be excluded or expelled from a trade union unreasonably. Several difficult questions raised by the enactment of this provision are discussed. The role of the Employment Appeal Tribunal(EAT) and the industrial tribunals in interpreting this provision is evaluated.
