Abstract:Member states have not been very interested in the NCPI, probably because they have had a negative attitude from the very beginning and they have been unwilling to legitimate its use. The EC's new market-access strategy has so far been successful as it is demonstrated by the opening of seven procedures under the TBR. Although the Commission, in its Explanatory Memorandum to the initial proposal for the TBR, emphasized that the objective of TBR was not to relax the conditions for standing of Community industries and for the trade affects suffered, but to adapt the instrument as a tool for the opening of third-country markets, it has strengthened the position of European industry.
