Abstract:The increasing use of antidumping (AD) and countervailing duty (CVD) measures by the major OECD trading countries in recent years has been well documented. The main reason for the growing interest in this phenomenon is the fear that the AD/CVD codes and regulations which were meant for a corrective purpose are now being increasingly used for legitimising selective, unilateral protection. Such apprehension is understandable in light of the fact that the above code and regulations contain considerable ambiguity in the provisions dealing with the determination of "dumping" and "injury", both of which are necessary conditions for imposing AD duties.
