Abstract:This article will examine the courses of action pursued by the European Commission under the TBR to remove offending obstacles to trade. As will be seen, in no instance has a TBR investigation led to unilateral measures resulting in a remedy that is inconsistent with the Community's obligations under the WTO. Furthermore, there has been no threatened use of the available countermeasures during these investigations to coerce allegedly recalcitrant States into inequitable settlements.
