Abstract:This article offers a historical sketch of the relationship between antitrust policy and business strategy. First, the author gives a brief account of antitrust economics since 1890 and present examples to illustrate the shifts in antitrust understanding of commercial purposes and effects. The he turns to what might be the next antitrust orthodoxy-game theory, which has captured the business school imagination but has not yet succeeded in the market for antitrust policy. This discussion employs business strategy informed by game theory, to develop a different understanding of the aggressive conduct examined in Eastman Kodak Co. v. Image Technical Services (1992), an important and controversial Supreme Court case.
