Abstract:The protective aim underlying the antitrust law is the decisive element for clarifying the vague legal concepts in that legislation. There is no conflict between a freedom-oriented goal and an efficiency-oriented goal for the traditional definition of efficiency. This is no longer true in the framework of Kaldor-Hicks. The real problem is the demarcation between competitive and anti-competitive behavior.
