Abstract:Bork (1978) pointed out important flaws in the courts' historic acceptance of foreclosure theory. A complete answer to the question of when vertical mergers are advantageous would involve a cost- benefit analysis. Probably the best solution is to decide according to the upstream of the downstream market's concentration ratio, since foreclosure effects are more likely to occur with situations in which one of these markets is highly concentrated.
