Abstract:This article debates whether a machine is capable of making a contract. Machines, of course, have long assisted human beings in contract formation by facilitating the communication of offers and acceptances. However, some machines have reached a level of sophistication such that they can, according to predetermined criteria, emulate a human decision. Indeed, they are already being used to reach agreements between themselves without any human involvement other than that of the programmer.
