Abstract:This article discusses the use of derogation from the Single Market rules and how this relates to the question of subsidiarity, in the context of the attempt by the European Commission (EC) to create an integrated Single Market providing for the free movement of goods , services, capital and people. The basic argument of this article is that, while subsidiarity may be politically necessary to ensure that member states accept the further integration of the Community, if it is used incorrectly in the practical implementation of the single market rules it may undermine the search for a truly open, competitive and non-discriminatory economic structure in Europe.
