Abstract:As confirmed last year by the Appellate Body in its Shrimp/Turtle ruling, access to WTO dispute settlement is and remains reserved to WTO members. Private parties, and in particular enterprises, have often complained about this. In an effort to meet these business's concerns, the European Community (EC) has enacted an instrument, which, in a certain sense extends from governments to business the exclusive right of WTO members to trigger WTO dispute settlement by permitting industries, or even individual companies, to lodge a complaint with the Commission alleging a WTO violation by a third country.
