Abstract: | In China's Laws of Foreign-Funded enterprises, the term "foreign fund" is implicit both in connotation and denotation; the pattern of investment in these enterprises enterprises is too diversified, which plus the irrational time-frame of payment, has given speculators many chances; the supranational treatment of foreign investors has resulted in the loss of domestic enterprises; sub-national treatment will violate conventions of the world trade agreement. Countermeasures include legal standardization of foreign investment, reference to international conventions, keeping in harmony with the world trade agreement, a through consideration of new trends of international investment in the process of improvement on legislation of overseas capital and agreement foreign economic policies with laws and systems. |
