Abstract: | In recent months, the European Court of Justice (ECJ) and the Court of the First Instance (CFI) have: confirmed that employs of firms involved in a merger could not, despite their procedural rights under the merger control regulation, challenge the merits of the Commission's decision authorising the concentration; confirmed the applicability of equal pay principles to piece-work pay; annulled several Commission decisions in competition cases on procedural grounds; accepted that trade associations could bring actions in state aid cases on behalf of their members. |
