Abstract:The medico-legal systems of workers' compensation are examined in this article. First an historical perspective is taken to locate the first workers' compensation laws, the circumstances that led to their implementation and their consequences in terms of the shift from individual fault to industrial risk. Then the discursive practices of medio-legal knowledge-power typically found in workers' compensation systems are examined. Finally, the effect of neo-liberal governmentality and its underlying economic rationality is summarized as it attempts to regulate, by means of the artifice of libery, the behaviours of companies and workers.
