Abstract:After recognizing that measures to protect trade were not able to deal with all kinds of illicit and unfair trade, EC introduced Regulation 2641/84. Definition of an "illicit commercial practice" is presented and interpreted. Objectives of the new procedure introduced by Regulation 2641/84 are discussed. Experience so far is presented analysing six procedures. Factors that must be examined in order to determine if injury is occuring, are listed, Community industry is defined. A complaint must be acting on behalf of the Community industry, and Community interest must be taken into account. It is concluded that Regulation 2641/84 has in few cases been useful.
