Abstract: | The question of resolving disputes concerning the alleged violation of intellectual property rights by foreign companies is discussed. The two concerned fora in the US legal system is described. The problems and conflicts in the present system are analyzed. The procedural characteristics of courts and the ITC are described. Leading cases pertinent to the issue of forum selection for international disputes are summarized. Alternative approaches to the allocation of disputes are suggested based upon the principle of matching. Recent developments in the functioning of the two fora are discussed and evaluated. |
