Abstract: | As few products are manufactured from start to finish in one country, the determination of the origin of products is becoming an increasingly complex exercise. The European Community's non-preferential rules of origin and the Kyoto Convention are discussed, the EC's basic instrument for determining non-preferential origin (Committee on Origin and its procedure) is explained, 14 product-specific origin regulations of EC are presented. Interpretation of regulation 802/68 by the European Court of Justice is discussed in connection with five prominent cases. The role of origin within the course of an antidumping proceeding, the problem of defining the domestic industry, etc. are analyzed. Changes in GATT articles and procedure improvements are proposed. |
