Abstract:Sexual harassment in the workplace may not involve anything as obvious as a demand for intercourse as a condition of employment. Harassment can start with a lousy joke. If untreated, management may have an expensive problem, since the USA Supreme Court has held that an employer may be liable for sexual harassment if its work environment is intimidating, hostile and offensive to the workers. It says it is "unlawful to discriminate against any individual with respect to ... conditions of employment". Some case studies are presented showing how the management behaved. If investigation indicates sexual harassment, take appropriate actions and document it. Review action and documentation with counsel in advance.
